LABUAN — A toy shop operator was issued a compound after failing to submit a Cheap Sale Notice before offering promotional prices to consumers, said the Ministry of Domestic Trade and Cost of Living (KPDN) Labuan.
The offence was detected during an inspection by a team of KPDN Labuan enforcement officers at a business premises around Ujana Kewangan Shopping Complex here.
The inspection found that the premises was conducting a cheap sale promotion but had failed to submit a Cheap Sale Notice to the Controller beforehand, as required under the Trade Descriptions (Cheap Sale Price) Regulations made under the Trade Descriptions Act 2011 (Act 730).
Following the non-compliance, a compound was issued against the operator in accordance with the applicable legal provisions.
Under Act 730, an individual convicted of an offence may be fined up to RM250,000 or imprisoned for up to three years, or both. For a second or subsequent offence, the fine may be increased to RM500,000, or imprisonment for up to five years, or both.
For a body corporate, a conviction may result in a fine of up to RM500,000, while a second or subsequent offence may incur a fine of up to RM1 million.
KPDN Labuan director Junaidah Arbain reminded all traders that cheap sale campaigns are not merely promotional strategies to attract consumers, but are subject to regulations that must be complied with.
She said the requirement to submit a Cheap Sale Notice was important to ensure that promotions were conducted in an orderly and transparent manner and that price information provided to consumers was not misleading.
“Monitoring of promotional activities and cheap sales at business premises will be carried out continuously to ensure that every offer advertised to consumers complies with the law.
“Traders are also advised to check and understand the relevant legal requirements before conducting any cheap sale promotion to avoid legal action,” she said in a statement today.
Junaidah said KPDN Labuan remained committed to ensuring fair and ethical trading practices, thereby giving consumers confidence that promotions and price offers in the market were conducted transparently and in compliance with the law.
