High Court Grants SC Leave To Commence Committal Proceedings Against Former APL Industries Director

KUALA LUMPUR — The Kuala Lumpur High Court today granted the Securities Commission Malaysia (SC) leave to commence committal proceedings against former APL Industries Bhd group executive director Tan Bee Geok for breaching the terms of a consent judgment entered with the SC in 2020.

The SC said in a statement that the consent judgment, entered on Sept 17, 2020, arose from proceedings against Tan for contravening Section 188(3)(a) of the Capital Markets and Services Act 2007 (CMSA).

The provision related to Tan communicating inside information concerning APL Industries Bhd to her sister, Tan Bee Hong.

Under the consent judgment, Tan had agreed, among others, not to act as a director of or be involved in the management of any public listed company (PLC) or its subsidiary for five years from the date of the judgment.

However, the SC said Tan subsequently continued to act as a director of subsidiary companies of a PLC and remained actively involved in their management, thereby breaching the terms of the consent judgment.

The SC had filed an ex-parte application for leave to commence committal proceedings against Tan on Sept 17, 2025, after which the High Court directed that the application be heard on an opposed ex-parte basis.

High Court judge Datuk Leong Wai Hong allowed the SC’s application and granted leave to commence the committal proceedings against Tan on Aug 12, 2026.

The SC said it views breaches of consent judgments in securities law cases seriously, as such conduct could undermine the effectiveness of regulatory enforcement and erode respect for court orders and the administration of justice.

“The commencement of committal proceedings underscores the SC’s commitment to ensuring compliance with court-sanctioned obligations and holding parties accountable for non-compliance,” it said.

The SC was represented by Mohd Hafiz Mohd Yusoff, Ng Chian Huey, Loo Kit Ming Keith and Siti Sarah Kamaruzaman, together with its appointed external counsel Benjamin John Dawson and Eileen Othman of Messrs Benjamin Dawson.

Tan was represented by Sivanesan Ravenesan and Siti Nur Amirah of Messrs S Ravenesan.
